Terms & Conditions

Please read the following terms, conditions and policies carefully. If you do not accept the following terms, conditions and policies please refrain from using ‘Reptile Creative’ and ‘Prestige Pythons’ websites. Both websites are owned and operated by the same owner.  The following information applies to both sites and is collectively referred to as ‘Reptile Creative’ hereafter.

OVERVIEW

Reptile Creative provides all the information, tools and services available on this website to the user conditionally upon the user’s acceptance of all terms and conditions stated here, and including all Reptile Creative policies and notices below and otherwise posted to this site.

‘Services’ includes all advice and recommendations.

‘The user’ refers to you.  These terms and conditions apply to all visitors of the website, including without limitation users who are browsing, purchasing, or contributors of content alike.

These terms and conditions also apply to visitors and customers of Reptile Creative’s physical retail shop at 40 Furness Avenue, Edwardstown SA 5039.

Reference to ‘us’, ‘we’, and ‘our’ throughout this site refer to Reptile Creative.

By visiting our physical and/or online sites and/or purchasing something from us, you engage in our service and agree to be bound by the terms and conditions set out hereafter, including any additional terms, conditions and policies referenced on this site or in our physical store.  

By agreeing to these terms and conditions, you represent that you are at least 18 years of age and able to enter into a legally binding contract, or you are at least 18 years of age and you have given us your consent to allow any of your minor dependents to use this website.  We reserve the right to hold liable the parent or guardian for any loss or damage caused by their minor. 

You may not use our products or services for any illegal or unauthorised purpose.  You are also prohibited from using any part of our service or products to violate any laws in your jurisdiction, which includes but is not limited to copyright laws. 

Breaching or violating any of the terms and conditions will result in an immediate termination of any services to you.

We reserve the right to refuse service to anyone for any reason at any time. 

We reserve the right to update, change or replace any part of these terms and conditions by posting updates and/or making changes to our website. It is the user’s responsibility to check this page intermittently for changes. The user’s continued use of, or access to the physical shop or website following the posting of any changes constitutes acceptance of those changes.

In the event that Reptile Creative fail to exercise or enforce any term, condition or policy stated, that failure shall not constitute a waiver of such term, condition or policy. 

Governing Law

Our terms, conditions, policies and any separate agreement whereby we provide you a service shall be governed by and construed in accordance with Australian legislation and regulations. 

Information on this site

Every effort is made to ensure the information on this site is accurate and current.  This includes, but is not limited to, the free resources, item descriptions, blog posts and other material published.  However, inaccuracies, typographical errors or omissions may exist due to human error, the passage of time or other such reasons.  It is your responsibility to consult other sources of information and publicly available research to make your decisions. The information on this site is provided for general information only and should not be relied upon as your sole source of information. Any reliance on the information published on this site is at your own risk. 

We undertake no obligation to amend, update or clarify any information published on our website or provided in store, except as required by law.
We reserve the right to correct any inaccuracies, typographical errors or omissions at any time.

We reserve the right to modify the contents of this website at any time, however we are under no obligation to update any information published to our website or provided in store.   You agree that it is your responsibility to monitor any changes made to the information we provide.

All content on our website, and social media sites including text, images, logo and design, is protected by copyright and intellectual property laws. You agree not to reproduce, duplicate or copy any part of this site, without express written permission by us. 

You are permitted to use this website for personal and non-commercial purposes only.
 
Products or services offered and modifications

We provide a full range of stock at our shop, 40 Furness Avenue, Edwardstown, and offer limited products for sale online.

We reserve the right to modify or discontinue an item or service (or any part of the aforementioned) without notice at any time.   We shall not be liable to you or to any third-party for any modification, price change or discontinued item.

Any new items, materials or features added to our physical store or website shall also be subject to these terms and conditions.

Prices for our items or services are subject to change without notice.  In some circumstances, the prices for the same item offered may differ between the physical store and online store. We are not obligated to price match between our own stores or any third-party store, and we shall not be liable for any compensatory payments where an item has been purchased at a higher price. By purchasing an item from us you agree to the price paid.   

We reserve the right to limit the sales of our items and services to any person, geographic region or jurisdiction.

We reserve the right to add a limit to the quantity of any item that can be purchased at any one time, per order or per person/household.  All items will be subject to our Returns Policy (detailed below).

Every effort is made to represent items offered for sale with accurate images in terms of colour, clarity and detail.  We cannot guarantee that your viewing device will display colour accurately or in the same hue, or that the actual item will not vary slightly from the website images. 
 
Live animals

We sell live animals. We consider their welfare to be paramount and therefore the order process and delivery of live animals differs from how we deal with dry goods.

Some of the live animals we have in stock are not considered appropriate for delivery. It is at our discretion whether an animal will be deliverable and by what means.  This will be decided on a case-by-case basis.  We reserve the right to refuse a sale of any live animal or creature under our care at any time.  

Every effort is made to provide accurate images online of live animals in terms of colour, clarity and detail. We cannot guarantee that your viewing device will display colour accurately or in the same hue.  Additionally, there may be slight variations in colour due to differences between a digital image and the actual animal. By purchasing the animal you agree to such variation should this occur, and where the variation is reasonable. We are not liable for any compensation or in any other way for slight variations perceived between an image and the animal.

Where there is discrepancy about the animal in comparison to its online image(s) contact Reptile Creative to discuss. 

Each State and Territory of Australia has its own rules and regulations regarding the importation and keeping of reptiles in captivity. It is your responsibility to consult your local government agency and gain the correct licence or permit where one is required.

Reptile Creative must complete an export permit for all live animals shipped. You will be asked when making an order to provide relevant details to complete the export permit and to comply with South Australia regulations.  You agree that any information you provide us is accurate, correct and in accordance with the legislation and regulations applicable to your locality.

Billing and account information

We reserve the right to modify, cancel or refuse an order at any time. An automatic electronic confirmation of an order does not obligate us to fulfil that order.

In the event that we modify or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

You agree to provide complete and accurate purchase and account information for all purchases made through Reptile Creative. You agree to promptly update details if they change.  This will enable us to complete your transactions and contact you as needed.

Third-Party Links

Our site includes links to third-party websites and services that may be of assistance to you. These links may direct you to third-party websites that are not affiliated with us.  

We are not responsible for the accuracy or appropriateness of any content, products or services provided by these third-parties. We have no liability or responsibility for any misinformation, harm or damages caused by accessing these third-party links or services. Make sure you review the terms and conditions for any third-party website you choose to interact with. Complaints, claims, concerns, or questions regarding third-party products or services should be directed to the third-party.

Comments and feedback from users

By providing us with comments or feedback, whether online, by email, by post, or by any other means including social media, you agree that we may edit, copy, publish or forward in any other way your comments, at any time, without restriction.

Should a user send us material, comments or feedback, we are under no obligation to maintain any material, comments or feedback in confidence; to pay compensation for any material, comments or feedback; or to respond to any material, comments or feedback. 

You agree that your comments or feedback will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. Limitation of Liability

Under Australian Consumer Law you have certain rights that cannot be excluded.

To the fullest extent permitted by law, Reptile Creative, its owner, employees and suppliers disclaim all liability for any loss, injury, or damage arising from the use or misuse of the information, products, or services offered on this website or in store. This includes, but is not limited to, indirect, incidental, or consequential damages.

You expressly agree that your use of, or inability to use, our service is at your sole risk. Moreover, any products sold by Reptile Creative are to be used at your own risk.

The items and products sold by Reptile Creative will come with the manufacturer’s directions for use.  It is your responsibility to carefully read and follow those directions for use. You agree to use any product purchased from us in accordance with the manufacturer’s directions/instructions and cannot hold Reptile Creative liable for any injury, damage or loss resulting from incorrect or poor use. We do not guarantee product effectiveness and individual results may vary.

Reptile Creative’s liability is limited to, and shall not exceed, the cost of the product purchased from us.

Disclaimer

As part of our customer service and commitment to enhancing the welfare of creatures and animals kept in captivity, we provide information, advice and guidance about care and husbandry for the animals and creatures we sell. The information provided by Reptile Creative, whether in writing, verbally, via this website or social media sites, or by any other means, is for general informational and educational purposes only. It is not intended as a substitute for professional medical advice, diagnosis, or treatment for your pet. Always seek the guidance of a veterinarian with any questions you may have regarding your pet’s health, medical conditions, or the use of any products or supplements.

We do not sell any animals showing signs of ill-health. We are not and shall not be responsible or liable for any harm or ill-health that befalls any animal or creature once it has left our care. We are not and shall not be responsible or liable for any costs associated with veterinarian care you seek regarding your pet.

The welfare of the animals we sell is very important to us as is your customer experience, we therefore provide aftercare by way of advice and guidance if you request it.  However, you agree that any harm or ill-health that befalls your animal or creature once it has left the care of Reptile Creative is your responsibility.  

You may be liable to prosecution and penalty under the law if you neglect, abuse or intentionally harm your pet in any way.

Updates and Changes 

Reptile Creative reserves the right to update or modify this disclaimer at any time without prior notice. It is your responsibility to review this disclaimer periodically to stay informed of any changes.

Acceptance of Terms 

By using this website, you acknowledge and agree to this disclaimer. If you do not agree, please discontinue the use of this website and any related services.

E-GIFT CARD POLICY

E-gift cards can only be redeemed for purchases at Reptile Creative.

Gift cards can be redeemed with one single payment, as part payment for an item, or in multiple transactions where the sum of the items purchased is less than the value of the gift card and a balance remains.

E-gift cards are not subject to an expiry date.

E-gift cards cannot be cancelled once purchased.

The following exclusions apply:
  • E-gift cards cannot be used to purchase other e-gift cards or exchanged for money.
  • No change will be given for any remaining e-gift card balance.
  • E-gift cards are non-transferable.
 
PRIVACY POLICY

We will handle your personal data in accordance with all applicable privacy laws, including the Privacy Act 1988 (AU).

When referring to ‘personal data’ or your ‘personal information’ we mean information such as your name, email and telephone number. In general terms, it is any information that can be used to personally identify you.

We use and retain your personal data to register you as a customer, to process and fulfil your orders and any refunds or exchanges, and to contact you if customer support is requested or required.

We may also use your data to let you know via email about new products and promotions available, about special events or workshops being offered, or to seek your feedback.

Your privacy is important to us at Reptile Creative and all personal data provided to us is treated as private and confidential.  We will never share or sell your information, except in such circumstances where we are required to disclose by law, or if you have violated our terms and conditions, or if you have expressly requested that we share your information. 

By interacting with our website or purchasing from our physical premises, you are agreeing to this privacy policy and how we use your data.  Your consent to the collection of your data is implied by your use of our services.  If you do not agree to this privacy policy, please refrain from using our services. If we use your data to contact you for marketing purposes, we will either ask you directly to opt-in, or provide you with an opportunity to opt-out. 

Additionally, we will use and retain contact information for our suppliers of stock and live animals in order to make purchases for the shop and communicate with said suppliers.

We will do our utmost to protect your information. However, the Internet is not inherently secure and we cannot guarantee that your personal information will always be secure. Transmitting personal information online is done at your own risk, and you should only provide personal information in a secure environment.

Third-parties

All credit card transactions are processed through a secure payment service provider using encrypted methods. Your credit card details may be held by our secure payment service provider. We use Square AU Pty Ltd card payment processing services as our ‘Point of Sales’ and online sales card payment processing service. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council.  For information on how this provider and other transaction processors handle your information, please read their privacy policies.
If you provide your personal data to a third-party via a link from our website, please be aware that the information you provide may be collected and managed by those third-parties, and you should familiarize yourself with their privacy policy.  We are not responsible for the content, actions or practices of any third-party websites. 

For clarity, Prestigepythons.com.au is not deemed a third-party website. It is controlled and operated by the owner of Reptile Creative.  This privacy policy also applies to any interaction with ‘Prestige Pythons’.

Data Retention

We will only retain your personal data for as long as required for the purposes of conducting our business, or for such a period as specified by law.

Cookies

When you use any website, small pieces of data may be collected and stored in your internet browser. This is done through the use of cookies and their purpose is to enhance your experience when using the website.  Cookies can also be used for online marketing.  Examples of cookie activity is when a website recognises and maintains your login status or remembers your preferences.  Our website may use cookies to improve functionality, customer experience and /or site analytics. Your internet browser’s ‘help’ section, may provide information on how to prevent your browser from accepting cookies.  Please be aware that by disabling the use of cookies on your internet browser, you may not be able to access the full content of our websites.

Information made public by you

We monitor our social media channels for any customer feedback or direct mentions of Reptile Creative and Prestige Pythons.  Please note that any information you post on social media channels will become public and may be available to other users and the general public.  By posting on public channels you imply that we can use your comments or feedback if so desired for purposes such as marketing.

From time to time we will review this policy. We reserve the right to update or modify this privacy policy at any time without notice.  Any changes will take effect immediately. Please check this page periodically to ensure you are familiar with our current practices.

DELIVERY POLICY

Delivery – Products/goods/equipment

Certain stock items are available for purchase from our online shop. We only deliver in Australia. 

If you are outside of Australia and wish to place an order, please contact, Reptile Creative via email  at [email protected], or contact the shop during our business hours on +61 8 8276 4291,  to discuss whether delivery is possible to your location. 

We send deliveries out on Tuesdays and Thursdays.  If you place an order on a Tuesday or a Thursday before 1.00pm, we will aim to pack and send your delivery that same day, but this may not be possible due to the size of the order to be packed, whether payment has been received or some other reason out of our control.  If your order cannot be packed that same day, it will be packed the following Tuesday or Thursday whichever precedes. 

Once your order has been sent out for delivery, you will receive tracking information via a text message and/or email.

When you place an order, you will be given the option of choosing either standard or express delivery.  The cost of delivery will be calculated at this point. If your location is unserviceable by our chosen delivery service you will not be provided with a delivery cost at checkout. We will contact you to work out an alternative delivery method and cost.

Please be aware that delivery times may vary depending on location, carrier and public holidays and therefore delivery times are only estimates, not guaranteed.

Whilst we aim to keep our advertised stock levels as accurate as possible, from time to time an item’s stock level may be incorrect.  If you order an item that is out of stock, we will contact you as soon as possible to advise and discuss a refund, alternative or if you would prefer to be placed on backorder. 

Delivery and communication regarding your orders rely on you providing us with accurate information.

Deliveries will not be sent out until payment has been received in full. Receipt and notification that your delivery is on its way will be sent to your email address. 

Delivery – Live animals

Certain live animals – snakes and lizards – are available for purchase online. You will be redirected to our other website www.prestigepythons.com.au to see our animals for sale.

The care and wellbeing of our live animals is very important to us.  We treat the sale and delivery of live animals differently to dry goods/products/equipment to ensure they are going to appropriate environments and that you receive an animal in good health and condition. 

You can place an order for a live animal by one of the following methods:

  3. Complete the online contact form on our prestigepythons.com.au website.

When placing an order for a reptile please include the following information:
  • Your full name
  • Your email address
  • Your contact telephone number
  • The code allocated to the reptile and its information (each reptile we sell online is allocated its own code for identification purposes).

Live animals will only ever be delivered within Australia.  It is illegal to export native animals outside of Australia.  Each State and Territory of Australia has its own set of rules and regulations governing the movement and keeping of reptiles, or certain species of reptiles.

Delivery and communication regarding your orders relies on you providing us with accurate information.

It is your responsibility to provide us with correct and accurate information.  You are responsible for any breaches of legislation or regulations that occur because of inaccurate information provided by you. 

We use Qantas freight to send live animals interstate.  Please be aware that delivery times provided are only an estimate.  We cannot guarantee a delivery time. You will be responsible for collecting your animal from the airport at the advised time.

Animals will not be made ready for transportation until full payment has been received.

Bank transfer is the preferred method of payment for live animals, but we will also accept credit card payments over the phone. Credit card payments may incur a credit card fee which will be payable by you and added to the total cost. 

By purchasing from Reptile Creative or Prestige Pythons either electronically, by phone or in person, you are confirming that you have read our terms and conditions and agree to be bound by these terms and conditions.

RETURNS AND REFUNDS POLICY

Overview

We will only replace or refund items that are defective or damaged through no fault of your own, or if you have received the wrong product due to a packing error; we do not accept returns for change of mind.

Neither we, nor the manufacturer, will replace or refund an item made faulty or defective through misuse or user error, so please read the instructions for use carefully prior to using the item purchased.

Where authorised, we endeavour to replace or refund your product as soon as possible and within a reasonable timeframe.  We will notify you when your replacement or refund can be expected. Please be aware, that this timeframe may vary due to the product itself, nature of the defect, fault or damage, your chosen method of returning the product to us (if applicable), and other issues out of our control such as public holidays or natural disasters. 

Nothing stated in our returns and refunds policy is intended to limit the application of the Australian Consumer Law.

In-store purchases

If you have made an in-store purchase and found the product to be defective or faulty, you can bring the product back to the store with proof of purchase within 14 days of purchase.  We will assess the product and if we agree that it is defective or faulty and the defect or fault has not occurred through abnormal use or user error, we will provide you with an exchange or refund.

Alternatively, if the defect or fault falls within the scope of the manufacturer’s warranty, we can assist you with making a claim under the warranty.

Online purchases - Items damaged in transit

If you have received a product from us which has been damaged in transit, please contact us by email at [email protected] to advise as soon as possible and within 48 hours of receiving your delivery.  

‘Your receipt of the parcel’ refers to the actual time it is delivered to you, regardless of whether the parcel was signed for or left in a safe place. 
You will need to email us information that identifies your order, along with photos of the damaged packaging before you open the item (if applicable) and photos of the damaged item itself. 

Once we have received your notification of damaged goods we will contact you to advise whether the product needs to be returned to us for assessment, and/or whether an exchange or refund is authorised.  Any products returned to us need to be received by Reptile Creative within 30 days of your receipt of delivery.  If the product is to be returned to us, no exchanges or refunds will be made until we have receipt of the original product.

Online purchases – defective or faulty items, or incorrect product

If you have received a product from us which you find to be defective, faulty or not the product you ordered, please contact us by email at [email protected] to advise within 14 days of receiving your delivery.

You will need to email us information to identify your order, advise of the issue you have found and any photos that may assist in our assessment. 
Once we have received your notification we will contact you to advise whether the product needs to be returned to us for assessment, and/or whether an exchange or refund is authorised.  Any products returned to us need to be received by Reptile Creative within 30 days of your receipt of delivery.  If the product is to be returned to us, no exchanges or refunds will be made until we have receipt of the original product.

WARRANTIES

Goods and products sold by us come with a manufacturer’s guarantee called a warranty. The term of that warranty varies depending on the product itself.  If your product is defective, faulty or becomes faulty it may fall within the scope of the warranty in which case we can assist you in making a claim.

If we assist you with a claim under the warranty we will ask the manufacturer to assess the product within a reasonable timeframe. Alternatively, you may find it more efficient to contact the manufacturer directly.

Warranties only apply to the original buyer. A warranty is null and void if the item has been modified, altered or misused.

Consumer guarantees are provided under Australian Consumer Law.  We will assist you if the product you purchased from us is faulty, or has become faulty, through no fault of your own; or if the product has defects or is not fit for the purpose stated. 

We will provide you with a replacement or refund if the defect or fault is major.  If the defect or fault is minor we may choose to repair the product. If the product cannot be repaired we will provide you with a refund or replacement. 

Warranty Returns

If you have an item that falls within the scope of the warranty, contact Reptile Creative by email at [email protected].  Please include details about the item, the defect or issue you have identified, the purchase date and proof of purchase, and any other relevant information in the first instance. 

Upon assessment of the information you provide, we will authorise you to return the product.  You will need to return it to our store at Reptile Creative, 40 Furness Avenue, Edwardstown SA 5039, to enable us to process your claim with the manufacturer. 

You are responsible for the whole cost of returning any product to us. We advise you to ensure the product is packaged securely and is tracked, as we cannot be held liable for any loss or damage in transit.

If we replace the product, the cost of sending you a replacement will be covered by us.
 
How to return a product (if applicable)

Please ensure any product being returned to us is packaged securely and is tracked in transit.  It is your responsibility to ensure the product reaches us in the condition it reached you.

The cost of returning the product to us is at your cost unless otherwise stated.
